Contest Rules

The following are the Offical Rules for the current contest that is running on our Website.

1. CONTEST: The Brookfield Residential LP I Heart McKenzie Towne/IHeartMT (the “Contest”) is conducted and sponsored by Brookfield Residential LP("Brookfield Residential"), a division of Brookfield Residential (Alberta) LP, by its general partner, Carma Ltd.. This Contest is not in any way sponsored or administered by Apple Inc. or Twitter.

2. ELIGIBILITY: To be eligible for the Contest (an "Eligible Entrant"), you must:

(a) be a resident of any province or territory of Canada (save and except for the province of Quebec); and

(b) have reached the age of majority in your province or territory of residence; and

You are not eligible for the Contest if you are a resident of Quebec. You are not eligible for the Contest if, during the Entry Period (defined below), you are an employee of Brookfield Homes, Brookfield Residential (Alberta) LP, Carma Ltd. or any company that is affiliated with or related to any of the foregoing, or a member of the immediate family (defined as mother, father, brother, sister, son, daughter, husband or wife, regardless of where they reside) or household of any of the above persons, their respective affiliates, agents, dealers, associates or representatives. All decisions regarding eligibility to enter the Contest will be determined by Brookfield Residential in its sole discretion. The Contest is void where prohibited by law.

3. NUMBER, APPROXIMATE VALUE OF PRIZE AND CHANCES OF WINNING: There is (1) grand prize available to be won in this Contest (the "Grand Prize") and nine (9) Weekly Prizes (the "Weekly Prize"). The Prize is described in paragraph 9 below. The chances of winning the Prize will depend on the number of Entry Submissions (defined below) by Eligible Entrants received in accordance with these Official Contest Rules during the Entry Period. The value of the Grand Prize is approximately $1500 (CDN), inclusive of all fees, charges and applicable fees.

4. CONTEST SCHEDULE: This Contest commences at 00:00 (Calgary time) on September 18, 2011 and closes at 16:00 (Calgary time) on November 18, 2011 (the “Entry Period”). An Entry Submission (defined below) must have been received during the Entry Period and must not have been removed from the Facebook Page prior to the time of the Draw (defined below) to be eligible to win the Prize.

5. HOW TO ENTER: No purchase is necessary to enter the Contest. To enter the Grand Prize, an Eligible Entrant must, during the Entry Period, visit a show home by Cardel Homes,Homes By Avi or Avalon Master Builder and complete an entry ballot (the “Grand Entry Submission”) to enter the Weekly Prize, an Eligible Entrant must, during the Entry Period, complete a twitter posting complete with the hashtag #IHEARTMT and comment about the community of McKenzie Towne (the “Weekly Entry Submission”). Each such comment posting made by an Eligible Entrant during the Entry Period in accordance with these Official Contest Rules shall constitute an Entry Submission. An Entry Submission can be made online or in the show home as aforesaid and no Entry Submission will be accepted by any other means. All late Entry Submissions and all Entry Submissions which Brookfield Residential determines in its sole discretion to be offensive, abusive, hateful, threatening, inappropriate, or harmful or potentially harmful to the reputation of Brookfield Residential, will be disqualified.

6. PRIZE DRAW DETAILS: A random draw (the "Draw") for the Grand Prize will be conducted at approximately 14:00 (Calgary time) on December 1, 2011. All Entry Submissions made during the Entry Period will be eligible for, and automatically entered into, the Draw. The Eligible Entrant whose Entry Submission is drawn and who has complied with these Official Contest Rules will be the winner of the Grand Prize (the "Grand Winner"). A random weekly draw (the "Weekly Draw") for the Weekly Prize will be conducted at approximately 16:00 (Calgary time) each Friday until November 18, 2011. All Entry Submissions made during the Entry Period will be eligible for, and automatically entered into, the Draw. The Eligible Entrant whose Entry Submission is drawn and who has complied with these Official Contest Rules will be the winner of the Grand Prize (the "Grand Winner").If necessary, should any Prize be unclaimed, or should the Winner be unwilling, unable or ineligible to win the Prize as set out in these Official Contest Rules, the Prize will be forfeited and Brookfield Residential shall have the right, but not the obligation, to draw, as replacements only, additional Entry Submissions. The selected Entry Submission and the Winner must comply with these Official Contest Rules. All matters relating to the Draw and the verification of the eligibility of an Eligible Entrant to be declared as the Winner will be conducted by Brookfield Residential in its sole and absolute discretion. All decisions made by Brookfield Residential in this regard are final and binding and cannot be challenged. Apple Inc. in no way endorses, sponsors, or supports this contest.

7. NOTIFICATION: Brookfield Residential will notify the Eligible Entrant whose Entry Submission has been selected by the Draw in accordance with paragraph 6 above by a phone call to the Grand Prize Winner and by a direct mention back to the Weekly Prize Winner on Twitter. By participating in this Contest, you consent to this method of notification.

8. DECLARATION OF WINNERS: An Eligible Entrant will not be declared a Winner until:

(a) Brookfield Residential has determined that such entrant is an Eligible Entrant pursuant to these Official Contest Rules; and

(b) The Eligible Entrant correctly answers a skill-testing question as set out in these Official Contest Rules.

9. PRIZES: There will be one (1) Grand prize consisting of one (1) Grand Prize Pack for an Apple iPad2 and accessories (approx value $1500). There will be nine (9) Weekly prizes each consisting of one (1) $50 Gift Card. In order to claim, accept and receive the Prize, the Winner must, by no later than 16:00 (Calgary time) on December 1, 2011, attend in person at the Brookfield Residential's Calgary head office (4906 Richard Road SW, Calgary, Alberta) to answer the skill-testing question described in paragraph 10 below, produce proof of such individual's identity, complete any forms required by Brookfield Residential and pick up the Prize, provided however the Prize will only be granted to a verified Winner. If the Prize is not claimed, accepted and received as aforesaid, then the Prize will be forfeited. The Prize is not redeemable for cash, is non-transferable and must be accepted as awarded with no substitutions, except at Brookfield Residential’s sole discretion. Brookfield Residential reserves the right, but is not obligated, to substitute a prize of equivalent monetary value if Brookfield Residential is unable to award the Prize as described. Brookfield Residential will not be responsible, however, if factors beyond the reasonable control of Brookfield Residential prevent the Prize from being fulfilled, and in any such event, the Winner will not be provided with a substitute prize or cash equivalent.

10. SKILL TESTING QUESTION: To win the Prize and prior to being declared a Winner, the Eligible Entrant must correctly answer, unaided, the mathematical, time-limited, skill-testing question as follows: 90 multiplied by 2 =_____.

11. CONTEST MODIFICATION OR CANCELLATION: Brookfield Residential reserves the right, without prior notice and at any time, to terminate the Contest, in whole or in part, or modify, suspend or extend the Contest in any way, if it determines, in its sole discretion, that the Contest is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including without limitation, computer viruses, glitches or printing or production errors) have destroyed or severely undermined the proper conduct, integrity, and/or feasibility of the Contest. Without limiting the generality of the foregoing, in the event Brookfield Residential is prevented from continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man made epidemic or health or other means, earthquake, explosion, labour dispute or strike, act of God or public enemy, riot or civil disturbance, terrorist threat or activity, war or any federal, provincial or local government law, order, or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the control of Brookfield Residential, then subject to any governmental approval which may be required, Brookfield Residential shall have the right to modify, suspend, extend or terminate the Contest.

12. PARTICIPATION: Participation in this Contest constitutes an agreement by each participant to comply with these Official Contest Rules.

13. DISQUALIFICATION: It is the participant’s responsibility to ensure that he/she has complied in full with all of the conditions and requirements contained in these Official Contest Rules. Brookfield Residential reserves the right, in its sole discretion, to disqualify any individual (including an Eligible Entrant) who is found to be tampering or attempting to tamper with the Entry Submission process or the operation of the Contest, or any website, including without limitation any website set forth or described in these Official Contest Rules; to be acting in violation of these Official Contest Rules; or to be acting in a disruptive manner, or with the intent to disrupt or undermine the legitimate operation of this Contest, or to annoy, abuse, threaten or harass any other person. Brookfield Residential reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.

14. RELEASE AND INDEMNIFICATION: By entering the Contest, each entrant: (a) releases and holds Brookfield Residential (Alberta) LP, Carma Ltd. and their respective directors, officers, employees, and agents, harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, bodily injury and property damage, or any other damage or loss, due in whole or in part, directly or indirectly, to participation in this Contest, any Contest related activity, or from acceptance, possession, use or misuse of the Prize, or participation in any Prize related activity; and (b) agrees to fully indemnify Brookfield Residential (Alberta) LP, Carma Ltd. and their respective directors, officers, employees, and agents, from any and all claims on the part of any third party or parties related in any way and for any reason to the Contest or to the Prize, including without limitation, death, and personal or property damage or injury.

15. LIMITATION OF LIABILITY: Brookfield Residential (Alberta) LP and Carma Ltd. assume no responsibility or liability for incorrect, damaged, illegible, incomplete, mutilated, spoiled, destroyed, stolen, misplaced, lost, late, misdirected or incomplete Entry Submissions, which may be judged void, any notifications, responses, replies, or for any computer, telephone, hardware, software or technical malfunctions that may occur. Brookfield Residential (Alberta) LP and Carma Ltd. assume no responsibility for any theft or destruction or unauthorized access to, or alteration of, Entry Submissions. Neither Brookfield Residential (Alberta) LP nor Carma Ltd. shall be responsible for any injury or damage to participants in this Contest.

16. PUBLICITY RELEASE: By entering this Contest, each Eligible Entrant whose Entry Submission is drawn hereby agrees and grants to Brookfield Residential, without further compensation, the unrestricted rights, but not the obligation, to the use his/her name, picture, portrait, likeness, voice, along with his/her address (City and Province) and any statements made by or attributed to such Eligible Entrant in any and all media, now known or hereafter devised, without notice, review or approval, in perpetuity and throughout the universe, for advertising and promotional purposes in connection with the Contest and other promotions, without further notice or compensation and releases Brookfield Residential (Alberta) LP and Carma Ltd. from any liability with respect thereto.

17. OFFICIAL RULES AND LAWS: These are the official Contest rules (the “Official Contest Rules”). This Contest is governed by and construed and enforced in accordance with the laws of the Province of Alberta and federal laws of Canada applicable therein and the parties hereby attorn to the jurisdiction of the courts of the Province of Alberta. In the event a court determines that this Choice of Law clause is invalid or unenforceable as against an Entry Submission, such Entry Submission will be void. These Official Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws. These Official Contest Rules, as amended from time to time, will be posted at Brookfield Residential Calgary head office at 4906 Richard Road SW, Calgary, Alberta, and online at http://www.livebrookfield.ca/Calgary/ContestRules

18. CONSTRUCTION: The invalidity or unenforceability of any provision of these Official Contest Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Contest Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained in these Official Contest Rules. Headings and captions are used in these Official Contest Rules solely for ease of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Contest Rules or any provision hereof. In these Official Contest Rules, words importing the masculine gender include the feminine gender and neutral gender and vice versa, and words importing the singular number include the plural, and vice versa, and words importing persons shall also mean firms, corporations and partnerships, all as the context shall require. Subject to paragraph 11 above, Brookfield Residential may from time to time modify or amend these Official Contest Rules by written notice posted at or on the municipal and website addresses described in paragraph 17 above.

19. PRIVACY: By participating in this Contest or providing or entering your Entry Submission in accordance with these Official Contest Rules, you agree to Brookfield Residential's use of your personal information for the purpose of administering the Contest.

20. PARAMOUNTCY: In the event of any conflict or inconsistency between the provisions of these Official Contest Rules and the provisions contained in any website, promotional materials, documents or any other agreements respecting the Contest, the provisions of these Official Contest Rules shall prevail and be paramount.
